The Law

The 1990 Human Fertilisation and Embryology Act

This act states that:

  • All donors should remain anonymous. (This has changed since 1st April 2005)
  • Both partners must consent to infertility treatment.
  • A donor is limited to making 10 donations. This is to limit the chances of the biological children resulting from the donations accidentally getting into sexual relations with each other.
  • If a woman gives birth as a result of egg donation, she is the mother of the child. The biological mother has no rights.
  • Embryos can be stored for up to 10 years.
  • Surrogacy is not allowed for money. Only expenses can be paid to the host mother.
  • Embryos can only exist for 14 days outside of a womb. After that they must be destroyed.

The 1985 Surrogacy Arrangement Act

This act states that it is illegal to advertise for surrogate host mothers or to pay an agency to make surrogacy arrangements.
